About this policy

This Privacy Policy sets out how Evergrow Mercantile Inc, trading as Rosier.US (“Rosier.US”, “we”, “us” or “our”), handles personal information. It covers the collection, use, disclosure and other processing of information associated with rosier.us (the “Site”), our online store, customer accounts, support communications and related services, collectively referred to as the “Services”.

Under applicable privacy and data-protection laws, Evergrow Mercantile Inc is generally the business or controller that determines how personal information gathered through the Services is used. This does not include situations in which another organization operates as an independent controller for its own services.

Our registered business address is:

Evergrow Mercantile Inc
1500 N GRANT ST STE R
DENVER CO 80302
US

The store is powered by the SHOPLINE e-commerce platform. To support its operation, SHOPLINE and other providers may process information on our behalf for storefront, account, checkout, transaction, order-management, analytics, security and associated functions.

This Policy concerns information that we process through the Services. Organizations acting independently of us have their own privacy policies, which this document does not replace.

The information we handle

What we collect varies with the ways you interact with us. The following categories may be involved:

Identity & contact details

Your name, email address, phone number, billing and shipping addresses, together with other details you give us when ordering or contacting our team.

Your customer account

Login information, account settings, saved addresses, previous orders and other details connected with your customer account.

Shopping & transactions

Items you view, consider or purchase; order references and transaction records; and information about returns, exchanges, gift cards, discounts and previous support interactions.

Payment information

Details used to complete payments, including billing information, the chosen payment method, transaction status and limited payment data that payment providers share with us. Those providers may handle full card details or other payment credentials directly.

Devices & browsing

IP addresses, browser types, device and network details, pages visited, links selected, referring pages, session activity, approximate location inferred from an IP address and comparable technical data.

Preferences & messages

Language and currency selections, marketing preferences, engagement with emails or messages, and details you submit through emails, forms, reviews, support requests or other correspondence.

During ordinary shopping, we do not deliberately ask for highly sensitive details such as health information, biometric identifiers, religious beliefs or government-issued identification numbers. Please avoid sending such information unless it is reasonably needed to address a particular request.

Where information comes from

Personal information may reach us in several ways:

  1. From you: when you visit the Site, register an account, buy something, join a marketing list, speak with Customer Care, seek a return or exchange, or otherwise share details with us.
  2. Through the Site: cookies, pixels, local storage, system logs and similar tools may gather information automatically while you use it.
  3. Through our providers: SHOPLINE, payment processors, fraud-prevention services, carriers, analytics services, communications providers and other vendors may supply information to support the Services.
  4. Through message activity: where measurement is permitted, we may learn whether an email was delivered, opened or clicked when you interact with our communications.

Why we use information

We may process personal information for the following purposes:

  • running, maintaining and developing the Site and Services;
  • setting up and administering customer accounts;
  • handling orders, payments, returns, exchanges, refunds, gift cards and other transactions;
  • organizing shipment, delivery, tracking and customs-related procedures;
  • answering questions, addressing complaints and requests, and providing customer support;
  • identifying, investigating and preventing fraud, abuse, unauthorized transactions, security incidents and other harmful conduct;
  • saving language, currency and other preferences;
  • evaluating Site performance, learning how customers use the Services and improving their experience;
  • sending operational communications, including order confirmations, delivery updates, account messages and policy notices;
  • sending email, SMS or WhatsApp marketing when you have opted in or when the law otherwise permits it;
  • providing shopping-cart reminders and similar commerce messages where allowed;
  • managing promotions, discounts, campaigns and other offers;
  • meeting legal, tax, accounting, regulatory and law-enforcement duties;
  • establishing, exercising or defending legal claims; and
  • fulfilling other purposes explained when we collect the information or authorized by you.

Cookies & related tools

Cookies, pixels, tags, local storage and comparable technologies may be used by us and our providers. They help the Site function, retain preferences, explain browsing patterns, improve performance and prevent fraud. Where activated and permitted, they may also assist with marketing or advertising.

Where applicable law requires consent, your consent selections determine our use of non-essential cookies and similar tools. Essential technologies may continue to function because they are needed for the Site or transaction you have requested. Your browser may also let you block or remove cookies, but doing so can affect how some Site features work.

Who receives information

When reasonably needed for the purposes set out in this Policy, we may provide personal information to these types of recipients:

  • Storefront and technology partners that host, run or support the store, accounts, checkout, order administration or customer-management features;
  • Payment and transaction partners that handle payments, authentication, refunds, chargebacks and fraud screening;
  • Shipping, logistics and customs partners involved in dispatching, tracking and delivering purchases;
  • Messaging and support partners that facilitate email, SMS, WhatsApp, customer assistance or transaction notifications;
  • Localization and commerce providers supporting language, translation, currency and related store features;
  • Analytics and advertising partners that, where enabled and permitted, measure usage, campaigns or advertising results;
  • Professional advisers, including legal advisers, accountants, insurers, auditors and consultants;
  • Public authorities or other parties when the law requires disclosure or when disclosure is reasonably necessary to safeguard rights, safety or security, or to prevent fraud; and
  • Participants in a business transaction involving a merger, financing, acquisition, reorganization, asset sale, insolvency or similar event.

We require providers to handle information only for authorized purposes and, where required, under appropriate contractual or legal obligations.

Our platform & providers

We build and run our store using SHOPLINE. In delivering the Services, SHOPLINE may handle shopper information for us, including data connected with browsing, registration, checkout, orders, payments, delivery, customer management and Site operations.

The tools and features active in our store determine which other providers may also process personal information on our behalf. When a provider acts independently, its processing may instead be governed by its own terms and privacy obligations.

Our providers may change as our business, technical requirements and operational needs develop. We will continue to handle personal information under this Policy and applicable law when those changes occur.

Marketing & your choices

When you sign up for marketing, we may use your email address or phone number to share product news, launches, promotions, restock announcements, cart reminders and other Rosier.US updates. Depending on availability, these may arrive by email, SMS or WhatsApp.

You do not need to agree to marketing to make a purchase. To leave an email list, use the unsubscribe link in a marketing email. For SMS, follow the opt-out directions in the message, such as replying STOP when that option is supported. You can also reach us at hello@rosier.us.

Opting out of marketing does not prevent us from sending non-promotional messages needed for your account, purchases, transactions, security or support requests.

Offers for subscribers

Joining a mailing or messaging list may come with a discount or another benefit. Taking part is optional. If applicable law classifies an offer as a financial incentive connected with personal information, we will supply any additional notices or terms required alongside that offer.

Advertising, sale & sharing

We do not exchange personal information for money by selling it.

Under some privacy laws, the terms “sale”, “sharing” and “targeted advertising” have a wider meaning. Certain disclosures of identifiers, device details or online activity to analytics or advertising partners may fall within those definitions. If technologies we use qualify and the applicable law gives you an opt-out right, we will make a way to exercise it available through privacy controls or by contacting us.

We do not knowingly sell or share children’s personal information in ways that applicable law prohibits.

Processing across borders

Rosier.US welcomes customers from different countries. Personal information may be processed by us and our providers in the United States and in other countries or regions where our technology, payment, shipping, support or other providers work.

Privacy protections in those locations may differ from those where you live. When required, we put appropriate legal mechanisms or safeguards in place for cross-border transfers of personal information.

How long we keep information

We keep personal information for the period reasonably needed to fulfil the purposes in this Policy. These include delivering the Services, maintaining business and transaction records, meeting legal, tax and accounting duties, preventing fraud, settling disputes and enforcing agreements.

Retention periods vary according to the information involved, why it was gathered, our relationship with you, relevant limitation periods, legal duties and security needs. Once information is no longer reasonably necessary, we may erase it, anonymize it or dispose of it securely in another way, subject to applicable law.

Protecting your information

We apply reasonable administrative, technical and organizational safeguards intended to protect personal information from unauthorized access, loss, misuse, alteration or disclosure. We also depend on providers that use security measures suited to the services they deliver.

Complete security cannot be promised for any website, transmission, storage arrangement or protective measure. Please keep your account credentials private and notify us if you think your account or information has been compromised; these responsibilities rest with you.

Exercising your privacy rights

The rights available to you depend on your location and applicable law. They may include some or all of the following:

  • asking to access the personal information we hold about you;
  • asking us to correct personal information that is inaccurate;
  • asking us to delete personal information, with exceptions permitted by law;
  • obtaining certain personal information in a portable format;
  • requesting that particular processing be restricted, or objecting to it;
  • revoking consent when consent is the basis for processing;
  • opting out of certain targeted advertising, sales or sharing where applicable;
  • appealing our decision on a privacy request where that right applies; and
  • using your privacy rights without unlawful discrimination.

Send requests to hello@rosier.us and use Privacy Request as the email subject. Explain what you would like us to do and include enough details for us to reasonably confirm your identity and find the relevant records. Where the law permits, we may request further information.

Where applicable, someone you authorize may act on your behalf. We may need evidence of that person’s authority and may also verify your identity directly.

Rights under U.S. state laws

Additional rights may be available when a U.S. state privacy law governs our processing of your information.

California residents

Where the California Consumer Privacy Act, including its amendments, applies, residents may be entitled to know about or access certain personal information, ask for deletion or correction, and opt out of sale or sharing. Where applicable, they may also limit certain uses of sensitive personal information and receive equal service and pricing when exercising their privacy rights.

Colorado & other states

Applicable state laws may give residents rights to access, correct or delete personal information and obtain a portable copy. They may also allow residents to opt out of certain targeted advertising, sales of personal data or profiling used to make decisions with legal or similarly significant effects.

If we refuse a request and you have a right to appeal under the applicable law, email hello@rosier.us with Privacy Appeal in the subject line.

The EEA, UK & Switzerland

For people in the European Economic Area, the United Kingdom or Switzerland, we may rely on the following legal grounds when handling personal information:

  • Contract performance: for example, managing an order, payment, account, return or delivery;
  • Legitimate interests: operating and improving the Services, tackling fraud, maintaining security, answering customers and assessing business performance, provided your rights do not override those interests;
  • Consent: including for certain marketing activities or non-essential cookies when required; and
  • Legal duties: meeting tax, accounting, consumer-protection, regulatory and law-enforcement requirements.

You may be entitled to access, correct or erase information, restrict or object to processing, receive certain information in a portable format, withdraw consent and complain to a competent data-protection authority. Revoking consent does not make processing carried out before that withdrawal unlawful.

Children & younger users

Our Services are designed for a general adult shopping audience, rather than for children younger than 13. We do not knowingly gather personal information online from children under 13 in circumstances that would require parental consent under applicable U.S. children’s privacy laws.

If you have not reached the age of majority where you live, involve a parent or legal guardian when using the Services wherever required. Please tell us if you believe a child has shared personal information with us inappropriately, so that we can examine the situation and respond appropriately.

Links to other services

You may find links on the Site to external websites, social platforms, payment services or other third-party services. Those organizations operate outside our control, and their independent privacy practices are not covered by this Policy. Before giving a third party personal information, we encourage you to read its own privacy information.

Updates to this policy

We may revise this Policy as our Services, technology, providers, business practices or legal requirements change. The date marked “Last updated” at the top shows which version is current.

For a material change, we may give further notice when appropriate or legally required. Please revisit this page periodically to stay informed.
